These Terms and Conditions ("Terms") apply to your access to and use of the website, online store and products of Arc Biohacking B.V. ("Arc Biohacking", "we", "us", "our").

By accessing our website, placing an order or using any of our services, you agree to be bound by these Terms. If you do not agree, you should not use the website or purchase our products.

Arc Biohacking B.V. is a company incorporated under the laws of the Netherlands.

2. Scope of these Terms

These Terms govern:

• Your use of our website and online store.
• The purchase and delivery of our physical palm cooling products for athletes and related accessories.
• Our returns and refund policy.
• Basic information about how we handle personal data and cookies.
• Our affiliate and referral programs, where applicable.

Specific policies, such as the Limited Warranty Statement and the Delivery Times and Costs page, form part of these Terms by reference.

3. Use of the website

You may use the website only for lawful purposes and in accordance with these Terms.

You agree that you will not:

• Use the website in any way that violates applicable law or regulation.
• Attempt to gain unauthorized access to any part of the website, server or network.
• Interfere with the security or proper functioning of the website.
• Use any automated means to access the website for scraping, data mining or similar purposes without our prior written consent.

We may suspend or terminate your access to the website at any time if we reasonably believe that you have violated these Terms or applicable law.

4. Products and orders

Our products are palm cooling devices and related physical accessories for athletes and similar users.

All product descriptions, images and other information on the website are provided for general information purposes only. We try to keep all information accurate and up to date, but we do not guarantee that product descriptions, images, pricing or other content are error free, complete or current.

An order is an offer to purchase a product. The contract between you and Arc Biohacking is formed when:

• You complete the checkout process and submit your order, and
• We confirm your order by email.

We reserve the right to refuse or cancel an order, for example in case of:

• Obvious errors in pricing or product information.
• Suspected fraud or misuse.
• Non availability of products.
• Orders to countries or regions to which we do not ship according to our Delivery Times and Costs page.

If we cancel an order after payment, we will refund the amount you paid for the relevant order.

5. Pricing, taxes and payment

All prices on the website are shown in Euros (EUR), including VAT where applicable, unless stated otherwise.

Prices may change from time to time. The price applicable to your order is the price shown at the time you place the order.

Unless stated otherwise:

• Local taxes, import duties, customs and any additional fees charged by your country of residence or by the shipping company are not included in the purchase price.
• You are responsible for any such additional costs.

Payment is due in full at the time you place the order.
We currently support common payment methods such as iDEAL, credit and debit cards (for example Mastercard, Visa, American Express), Apple Pay, Google Pay, Giropay and PayPal, subject to availability in your country.

We may change or discontinue payment methods at any time.

6. Shipping, delivery and risk

We ship to multiple countries worldwide. The countries we ship to, the expected delivery times and the applicable shipping costs are described on our "Delivery Times and Costs" page. We do not ship to countries listed there as excluded.

Any delivery times stated on the website or in order confirmations are estimates only. Actual delivery times can depend on your location, carrier performance, customs processing and other factors outside our control.

If your order is delayed significantly, we will inform you where reasonably possible and you may have the right to cancel the order and receive a refund.

The risk of loss or damage to the products passes to you when the products are delivered to the delivery address you provided or when they are collected by you or an appointed third party.

You are responsible for providing a complete and correct delivery address. We are not responsible for non delivery or delays caused by incorrect or incomplete address details.

7. Returns and refunds

We want you to be happy with your purchase. In addition to any mandatory consumer rights that may apply, we offer the following contractual return policy.

30 day full refund policy

You may return products purchased directly from Arc Biohacking within 30 days after the date of delivery for a full refund of the purchase price, subject to the conditions below.

Conditions:

• You must notify us of the return within 30 days after delivery, for example by email.
• You must return the products to us without undue delay and in any case within 30 days after you informed us of your wish to return.
• Products should be returned with all originally supplied accessories and, if reasonably possible, in the original packaging.
• You are responsible for the direct cost of returning the products, unless we clearly state otherwise or the product was delivered to you faulty or damaged.

You may inspect and handle the product to the extent necessary to determine the nature, characteristics and functioning of the product, similar to what you could do in a physical store. If you use the product more than is necessary for such inspection and the product shows signs of use, we may reduce the refund to reflect any diminished value, in line with applicable consumer law.

Custom or personalized products are currently not offered. If we introduce such products in the future, separate return conditions may apply.

Refunds

Once we have received and inspected the returned products, we will process your refund as soon as reasonably possible and in any case within 14 days after receipt of the returned products, provided that your return meets the conditions above.

Refunds will be made using the same payment method that you used for the original transaction, unless we agree otherwise with you.

This contractual return policy does not limit any mandatory statutory rights you may have under applicable consumer protection laws, including any legal right of withdrawal for EU or UK consumers.

8. Warranty

Our products are covered by our Limited Warranty Statement, which forms part of these Terms. The Limited Warranty Statement describes:

• The duration of the warranty.
• What is covered and what is not covered.
• How to submit a warranty claim.

In short, any defects or non conformity of the product must be notified to Arc Biohacking in writing within the period stated in the Limited Warranty Statement after the defect has been discovered.

Nothing in these Terms or in the Limited Warranty Statement is intended to limit any legal rights you may have under mandatory consumer protection laws.

9. Product use and medical disclaimer

Our products are designed as palm cooling devices for athletes and similar users. They are not medical devices.

• Our products are not intended to diagnose, treat, cure or prevent any disease or medical condition.
• The information on our website, packaging and marketing materials is for general information only and does not constitute medical advice.
• Always consult a qualified healthcare professional before using our products if you have any medical condition or concerns.

You should not use our products:

• If you have a medical condition that makes you sensitive to cold or that makes exposure to cold dangerous, such as certain circulatory, cardiovascular, neurological or skin conditions.
• If you are unsure whether cold exposure is safe for you.
• By children or persons who cannot safely understand and follow the instructions for use.
• In any way that is not consistent with the instructions, recommended operating conditions or technical specifications provided by us.
• In extreme environmental conditions that fall outside the ranges mentioned in our documentation, or in combination with unauthorized accessories or modifications.

Use of our products is at your own risk. You are responsible for using the products according to the instructions and for monitoring your own physical response. If you experience pain, discomfort, numbness, dizziness or any other concerning symptoms, stop using the product immediately and consult a healthcare professional.

10. Personal data and privacy

We take your privacy seriously and aim to process personal data in a lawful, fair and transparent way.

When you use our website or purchase our products, we may collect the following types of personal data:

• Identification and contact details, such as name, email address, shipping and billing address, phone number.
• Order and payment data, such as products purchased, order history and partial payment details as processed by our payment providers.

• You own or have the necessary rights to the User Content you submit.
• Your User Content does not infringe the rights of any third party and does not violate applicable law.

We may remove or decline to publish User Content at our discretion, for example if it is offensive, illegal or misleading.

All content on the website is owned by or licensed to Arc Biohacking and is protected by copyright, trademark and other intellectual property laws. This includes, without limitation:

Participation in any such program is subject to:

• Any additional program specific terms that we may provide at the time of registration.

By participating as an affiliate or referrer, you agree that you will not:

• Engage in spam, unsolicited emails or messages, or any misleading advertising.
• Misrepresent Arc Biohacking, our products or your relationship with us.
• Use paid search on our brand names in a way that violates our program rules.
• Use coupon or voucher sites or similar methods if we have not explicitly allowed this.
• Generate self referrals or manipulate tracking in any way to gain commissions unjustly.

We reserve the right to:

• Review and approve or reject affiliate applications at our sole discretion.
• Withhold, adjust or cancel commissions in case of chargebacks, refunds, suspected fraud or violation of the program rules.
• Terminate your participation in the affiliate or referral program at any time if we reasonably believe that you have violated these Terms or the program rules.

Any specific details about commission rates, payout thresholds and payment methods will be provided in the affiliate or referral program documentation.

15. Limitation of liability

Nothing in these Terms is intended to exclude or limit liability where this would be unlawful, such as liability for death or personal injury caused by our negligence, or any statutory rights you may have as a consumer under mandatory law.

To the fullest extent permitted by law:

• Arc Biohacking and its directors, employees and agents will not be liable for any indirect, incidental, special, punitive or consequential damages arising out of or in connection with the use of our website or products. This includes, without limitation, loss of profit, loss of data, loss of business or other economic loss, even if we have been advised of the possibility of such damages.
• Our total aggregate liability for any claim relating to the purchase or use of a product will not exceed the amount you paid for that product.

You are responsible for ensuring that the products are suitable for your intended use and that you use them safely and according to our instructions.

16. Indemnification

You agree to indemnify and hold harmless Arc Biohacking and its directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with:

• Your breach of these Terms.
• Your misuse of the website or products.
• Your violation of any law or the rights of any third party.
